Trump Asks Top Court Approval for National Guard Troop Deployment in the State of Illinois

On the last weekday, the government petitioned urgently to the nation's highest court, requesting authorization to send national guard troops to the state of Illinois.

This action is part of a wider campaign to widen the homefront role of the armed forces in a number of cities run by Democrats.

Legal Battle Over Guard Activation

In an emergency filing, the US Department of Justice asked the judiciary to set aside a earlier court order that had halted the stationing of a few hundred military reserve troops to the greater Chicago.

The district judge had expressed skepticism about the White House's reasoning for deploying forces, challenging its explanation in given local conditions.

A appellate court upheld the initial ruling on the previous day, leaving the deployment on pause while the court case continues.

Administration's Justifications

The top government lawyer, representing the administration, wrote in the new filing that federal law enforcement have frequently been “menaced and targeted” in downtown Chicago and the suburb of Broadview.

This site is home to an ICE detention center.

The commander-in-chief has earlier sent national guard forces to Chicago, Illinois and Portland, Oregon, following earlier deployments to LA, Memphis, and Washington DC.

The White House has stated that troop deployment is required to reduce protests and support immigration enforcement.

Partisan Resistance

Democratic officials have pushed back sharply the decision, claiming that the administration's assertions are inflated and partisan in nature.

They allege the former president of abusing his executive power to target political rivals.

The judiciary have also expressed doubt about the White House's description of ongoing incidents.

Regional authorities claim that protests over deportation policies have been largely small and peaceful, challenging the president’s portrayal of “combat area” circumstances.

Statutory Grounds

At the core of the legal battle is the president’s use of a national law permitting the commander-in-chief to take control of the military reserve only in cases of rebellion or when “unable with the federal troops to carry out the statutes of the US”.

The administration maintains that the personnel are essential to protect US facilities and agents from demonstrators.

Latest Events

Earlier this month, the White House nationalized three hundred personnel of the Illinois military reserve and directed extra guard from Texas personnel into the region.

As state authorities condemned the decision, the former president escalated his rhetoric, urging the detention of Chicago’s mayor and the governor of Illinois, both Democrats, charging them of not managing to protect immigration officers.

Illinois and Chicago together took legal action against the government to halt the deployment.

On October 9, the presiding federal judge, appointed by Joe Biden, delivered a temporary injunction preventing the command.

Regional Events

Simultaneously in Chicago, at least 11 people were detained outside the ICE facility in Broadview following heated confrontations between state law enforcement and protesters.
